ברוכים הבאים לאתר החברה הישראלית לכימיה (החי״ל, ע.ר. 580089936). האתר מנוהל ומופעל ע"י החי״ל. הגישה לאתר והשימוש בו, ובכלל זה בתכנים הכלולים בו ובשירותים השונים המוצעים בו, כפופים לתנאי השימוש המפורטים כדלקמן (להלן: "התקנון"), המסדירים את היחסים בין הנהלת האתר לבין כל גולש ו/או צופה ו/או משתמש באתר עבור כל מטרה שהיא, ו/או במידע המצוי באתר, במישרין או בעקיפין (להלן: "המשתמש" או "הגולש״).

⦁ הגדרות
⦁ גולש/משתמש הוא: אדם או חבר בני אדם, לרבות תאגיד, העושים שימוש ברשת האינטרנט, בין באמצעות מחשב, בין באמצעות תקשורת סלולארית, ובין באמצעות כל מדיה אחרת, קיימת או עתידית.
⦁ "הנהלת האתר" עמותת החי״ל, לרבות מנהלי הארגון ועובדיו, או כל מי שפועל מטעמו.
⦁ תכני גולש, כל תוכן שגולש העלה ו/או יעלה לאתר (לרבות בכל אחד מהשירותים המוצעים באתר), ובכלל זה מילים, תמונות, וידאו, תכני שמע (קול), תוכנה, שילוב של וידיאו ותכני שמע קול, או כל תוכן אחר המתאפשר להעלות אותו לאתר.
⦁ כללי
תקנון זה מנוסח בלשון זכר, אך מתייחס לשני המינים כאחד. כל האמור בתקנון זה בלשון זכר מתייחס גם לנקבה ולהיפך וכל האמור בלשון יחיד, מתייחס גם לרבים ולהיפך.
⦁ אין לראות הוראה מהוראות תקנון זה כגורעת מהוראה אחרת אשר בתקנון זה. הכותרות בתקנון זה הן לצורך הנוחות בלבד.
⦁ גלישה באתר או כניסה אליו או שימוש בשירותים המוצעים בו, מבטאת ומהווה הסכמה מצדך לתנאי תקנון זה, והם יחולו על כל פעולה שביצעת או תבצעי באתר. אם אינך מסכים/ה לתנאי השימוש, כולם או חלקם, הנך מתבקש/ת שלא לעשות כל שימוש באתר.
⦁ עמותת החי״ל שומרת לעצמה את הזכות לעדכן ו/או למחוק מעת לעת את ההוראות בתקנון זה, לפי שיקול דעתה הבלעדית וללא צורך במסירת הודעה כלשהי מראש, ותנאים חדשים אלו יחייבו את הגולש מרגע פרסומם באתר.
⦁ בכל שירות או פרסום הנמצא באתר שלגביו לא נקבעה הוראה מסוימת יחולו הוראות תקנון זה.
⦁ ככל שתהיה סתירה בין הוראות תקנון זה לבין הוראות הנוגעות לפרסום מכל סוג שהוא באתר, תגברנה הוראות תקנון זה, והן אשר תחייבנה את הגולש ביחסיה עם החברה הישראלית לכימיה.
⦁ על אף האמור בסעיף 2.6 החברה הישראלית לכימיה רשאית לקבוע הוראות מסוימות בפרסומים או בשירותים אחרים הנמצאים באתר, תוך ציון מפורש שהוראה זו גוברת על הוראות תקנון זה.
⦁ כל גולש מוזמן להשתמש באתר, כל עוד הוא מקבל על עצמו את התנאים של תקנון זה יחד עם זאת, עמותת החי״ל רשאית למנוע/ להגביל השתתפות של גולש כלשהו (בכל האמצעים העומדים לרשותה) בחלק מהשירותים או בכולם, לתקופה מוגבלת או בלתי מוגבלת, בהתאם לשיקול דעתה הבלעדי ומכל סיבה הנראית לה, עמותת החי״ל תהיה רשאית לעשות כן ככל שתהיה סבורה, ולפי שיקול דעתה הבלעדית ומכל סיבה הנראית לה מוצדקת וסבירה, ללא מתן כל הסבר או נימוק להחלטה כאמור.
⦁ גולש שהשתתפותו נמנעה/הוגבלה כאמור, לא יהיה רשאי לשוב ולהשתתף תחת שם משתמש אחר בתקופת ההגבלה.
⦁ הזכויות של עמותת החי״ל
⦁ כל הזכויות, לרבות זכויות הקניין הרוחני באתר ובשירותים הינם של עמותת החי״ל, או של צדדים שלישיים שהעניקו לעמותת החי״ל הרשאה להשתמש בהם במסגרת האתר והשירותים כאמור.
⦁ מבלי לגרוע מן האמור, עמותת החי״ל הינה הבעלים הבלעדי במאגרי הנתונים של האתר, בשמות ובסימנים המסחריים של האתר, בפטנטים ובמדגמים של האתר, בין שהם רשומים ובין שאינם רשומים, בסודות מסחריים הכרוכים בהפעלת האתר ובהענקת השירותים, בעיצוב האתר, במידע הטכנולוגי הכרוך בהפעלתו, לרבות, תוכנות, יישומים, קבצים גראפיים ואחרים, קודי מחשבים, טקסטים ו/או כל חומר או מידע אחר הכלול בו - למעט תכני גולשים כהגדרתם בתקנון זה.
⦁ כתוצאה משימושך באתר עמותת החי״ל עשויה לשלוח לך מידע הנוגע לפעילות העמותה באמצעות מגוון ערוצים, ככל שאינך מעוניין לקבל מידע כאמור הנך רשאי להודיע על כך לעמותה באופן שיצוין יחד עם המידע הנשלח.
⦁ המידע באתר
⦁ לעמותת החי״ל נתון שיקול הדעת הבלעדי להחליט על מגוון התכנים שיופיעו באתר, היכן הן יוצבו, וכן על אופן העיצוב, ועל משך הזמן שיוצגו באתר.
⦁ אין להעתיק, להפיץ, לשכפל, ליצור יצירות נגזרות, להציג בפומבי, להעמיד לרשות הציבור או למסור לצד שלישי את המידע ו/או כל חלק הימנו. אין לשנות, לפרסם, לשדר, להעביר, למכור, להפיץ או לעשות שימוש מסחרי כלשהו במידע או בכל חלק ממנו, אלא בהיתר מראש ובכתב של הנהלת האתר.
⦁ הנהלת האתר אינה אחראית לכל נזק ישיר או עקיף, ממוני או לא, אשר יגרם למאן דהוא, כתוצאה משימוש/הסתמכות על המידע/הנתונים, או על כל שירות אחר הנמצא באתר.
⦁ הנהלת האתר לא תישא בכל אחריות למידע או תכנים המפורסמים ע"י צדדים שלישיים, ולא תישא באחריות על כל נזק ממוני או לא, שיגרם למאן דהוא כתוצאה משימוש או הסתמכות, על מידע או תכנים כאמור.
⦁ הנהלת האתר מפרסמת מעת לעת מידע איכותי ככל הניתן בגין שירותים ומסגרות במגוון תחומים, יחד עם זאת הפרסומים האמורים אינם מהווים התחייבות או גושפנקה לפעילות תקינה של המסגרות והשירותים כאמור.
⦁ הימצאותם של קישורים ("לינקים") לאתרים אחרים אינם מהווים ערובה לתכנים באתרים אלה מבחינת מהימנותם, שלמותם, או מכל בחינה אחרת.
⦁ מבלי לגרוע מהאמור, עמותת החי״ל אינה אחראית על כל טעות במידע או בתכנים המפורסמים באתר, בין אם על ידה ובין אם על ידי צדדים שלישיים, והחובה מוטלת על הגולש לנקוט משני זהירות בעת השימוש במידע ובתכנים כאמור.
⦁ המידע והתכנים באתר אינם באים להחליף כל ייעוץ מקצועי באשר הוא, על כן, החובה מוטלת על הגולש לעשות את הבדיקות ההולמות בטרם ההסתמכות והשימוש במידע ובתכנים המופיעים באתר.
⦁ מידע ופרטים הנמסרים ע"י המשתמשים באתר
⦁ הנהלת האתר מתחייבת לשמור על סודיות מוחלטת באשר לפרטים אישיים הנמסרים על ידי המשתמשים באתר ואינם מיועדים לפרסום לכלל הציבור, ובכלל זה מידע בדבר אמצעי תשלום ככל שישנן, ופרטים התקשרות, ואולם הנהלת האתר לא תישא בכל אחריות כלפי המשתמשים כאמור במקרה של פריצה למאגרי הנתונים באתר.
⦁ על אף האמור בסעיף 5(1) הנהלת האתר לא תישא באחריות בדבר נזק בין אם הוא ישיר ובין אם עקיף בין אם ממוני ובין אם לא, הנגרם למשתמש כתוצאה מפריצה לאתר על ידי גורם כל שהוא, אשר נחשף למידע הנוגע למשתמש כאמור, בין אם שאותו גורם עשה שימוש לרעה במידע זה בין אם במתכוון ובין אם לא.
⦁ הנהלת האתר מתחייבת שלא להעביר כל פרט הנמסר על ידי המשתמש, ואשר אינו מפורסם ברבים, לכל צד שלישי, אלא אם הדבר נחוץ לשם מניעת פגיעה באתר, בהנהלת האתר ובלקוחות האתר, ובכפוף לכל דין המחייב את הנהלת האתר להעביר מידע כאמור, או במקרה אחר המתאים בנסיבות העניין.
⦁ מבלי לגרוע מהאמור, באשר לכל מידע הנוגע למשתמש אשר מפורסם ברבים, לא תהיה כל מניעה לעשות בו שימוש, בין אם על ידי הנהלת האתר ובין אם על ידי כל גורם אחר, שימוש כאמור כולל העתקה, פרסום, צילום, או כל שימוש אפשרי אחר.
⦁ חל איסור על כל משתמש באתר באשר הוא לפרסם או להעביר באמצעות האתר כל מידע שהוא שקרי, מעליב, משמיץ, מאיים, פוגע בפרטיות הזולת, פורנוגרפי, בעל אופי מיני, גזעני, או בלתי חוקי.
⦁ תרומות
⦁ באתר זה מתאפשר לתרום כסף לטובת צרכי העמותה בדרך מאובטחת, קלה ומהירה באמצעות כרטיס אשראי. תרומות בכרטיס אשראי מוגבלות מגיל 18 ומעלה בלבד.
⦁ מבצע פעולת התרומה יהיה רשאי לפנות לחברה הישראלית לכימיה בבקשה לשינוי פרטי החיוב וביטול עסקה, ניתן לבטל עסקה כאמור בתוך 14 יום מיום שבוצעה פעולת התרומה באמצעות האתר. עמותת החי״ל תבצע את השינוי הנדרש בהתאם למדיניות הנהוגה באותה עת בחברת האשראי. ככל שחברת האשראי תחייב את עמותת החי״ל בעמלה בגין הפעולה, יחויב מבצע הפעולה בעמלה כאמור.
⦁ ביטולי עסקה יעשו עפ"י חוק הגנת הצרכן 1981.
⦁ אין לתת פרטים כוזבים. הגשת פרטים כוזבים הנה עבירה פלילית. גולש שיעבור על עבירה זו צפוי להליכים משפטיים, פליליים ואזרחיים.
⦁ ככל שהעסקה לא אושרה ע"י חברת האשראי, יקבל מבצע הפעולה הודעה מתאימה. על מנת להשלים את הפעולה על מבצע הפעולה ליצור קשר עם החברה הישראלית לכימיה.
⦁ הנהלת האתר לא תישא בכל אחריות לפעילות בלתי חוקית שתיעשה על ידי משתתפים באתר או בגין כל גורם אחר שאינו בשליטתה המלאה.
⦁ פרטיות וסודיות המידע
⦁ עמוד הסליקה באתר מאובטח בהצפנת SSL 2048bit, המידע אודות הפעולה מוצפן בהתאם להנחיות תקן PCI הבינלאומי, והכול בכדי להבטיח את חיסיון הפרטים והמידע באופן המרבי ככל הניתן.
⦁ המידע הנמסר על ידך באתר נועד לצורך השימוש באתר, וישמר על פי חוק הגנת הפרטיות, התשמ"א - 1981. העמותה מתחייבת לעשות כמיטב יכולתה, באמצעים העומדים לרשותה, כדי לשמור על המידע ולסכל פגיעה אפשרית בפרטיות המידע שנמסר על ידך, אך עם זאת, אין בידיה לשלול שיבושים באופן מוחלט ולפיכך היא לא תישא בכל אחריות שהיא עקב פגיעות, תקלות ו/או שיבושים שיגרמו כאמור.
⦁ הדין החל וסמכות השיפוט
⦁ דיני מדינת ישראל יחולו על תקנון זה ועל כל הנובע ממנו או הכרוך בו, תקנון זה יפורש על פיהם, וכל סכסוך או שאלה משפטית בקשר אליו תובא להכרעה בערכאה השיפוטית המוסמכת במחוז ירושלים.

⦁ Definitions
1.1. A surfer/user is: a person or a group of people, including a corporation, who use the Internet, either through a computer, through cellular communication, or through any other media, existing or future.
1.2. "Site management": the ICS, including the organization's managers and employees, or anyone acting on its behalf.
1.3. Surfer's content, any content that a surfer has uploaded and/or will upload to the site (including in any of the services offered on the website), including words, images, video, audio content (voice), software, a combination of video and audio content, or any other content that can be uploaded same to the site.
⦁ General
2.1. These regulations refer to both genders equally. Everything stated in these regulations in the masculine language also refers to the female and vice versa, and everything stated in the singular also refers to the plural and vice versa.
2.2. A provision from the provisions of these regulations should not be seen as detracting from another provision contained in these regulations. The headings in these regulations are for convenience only.
2.3. Browsing the website or entering it or using the services offered on it, expresses, and constitutes your agreement to the terms of these regulations, and they will apply to any action you have taken or will take on the website. If you do not agree to the terms of use, all, or part of them, you are asked not to make any use of the site.
2.4. The ICS reserves the right to update and/or delete from time to time the instructions in these regulations, at its sole discretion and without the need to deliver any notice in advance, and these new conditions will bind the surfer from the moment they are published on the website.
2.5. The provisions of this regulation will apply to any service or publication on the website for which no specific provision has been established.
2.6. To the extent that there is a contradiction between the provisions of these regulations and provisions relating to advertising of any kind on the website, the provisions of these regulations will prevail, and they will be binding on the user in his relations with the ICS.
2.7. Notwithstanding what is stated in section 2.6, the ICS may establish certain provisions in publications or other services on the website, expressly stating that this provision overrides the provisions of these regulations.
2.8. Any surfer is welcome to use the website if they accept the terms of these regulations. However, the ICS may prevent/limit the participation of any surfer (by all means at its disposal) in some or all of the services, for a limited or unlimited period, In accordance with its sole discretion and for any reason that appears to it, the ICS will be entitled to do so as it deems, and according to its sole discretion and for any reason that appears to be justified and reasonable, without providing any explanation or reasoning for such a decision.
2.9. A surfer whose participation was prevented/restricted as mentioned, will not be allowed to return and participate under a different username during the restriction period.
⦁ The rights of the ICS
3.1. All rights, including intellectual property rights in the site and services belong to the Army Association, or to third parties who have granted the ICS permission to use them within the aforementioned website and services.
3.2. Without detracting from the aforementioned, the ICS is the sole owner of the website's databases, the website's names and trademarks, the website's patents and designs, whether they are registered or not, commercial secrets involved in operating the website and providing the services, the design of the website, the technological information involved in its operation , including, software, applications, graphic and other files, computer codes, texts and/or any other material or information contained therein - with the exception of surfers' content as defined in these regulations.
3.3. As a result of your participation on the site, the ICS may send you information regarding the association's activities through a variety of channels, as long as you do not wish to receive such information, you may notify the association of this in a manner that will be specified along with the information sent.
⦁ The information on the website
4.1. The ICS has the sole discretion to decide on the variety of content that will appear on the site, where they will be placed, as well as the manner of design, and the length of time they will be displayed on the site.

⦁ Information and details provided by website users
5.1. The management of the site undertakes to maintain absolute confidentiality regarding personal details provided by the users of the site and are not intended for publication to the general public, including information regarding means of payment if any, and contact details, however the management of the site will not bear any responsibility towards the aforementioned users in the event of a hacking of the databases on the site.
5.2. Notwithstanding what is stated in Section 5(1), the management of the site shall not be held responsible for any damage, whether direct or indirect, whether monetary or not, caused to the user as a result of a hacking of the site by any party, who is exposed to information concerning said user, whether the same A party misused this information whether intentionally or not.
5.3. ⦁ Contributions
6.1. On this website it is possible to donate money for the needs of the association in a secure, easy and fast way using a credit card. Credit card donations are limited to ages 18 and over only.
6.2. The person carrying out the donation operation will be entitled to contact the ICS with a request to change the billing details and cancel the transaction, such a transaction can be canceled within 14 days from the day the donation operation was carried out through the website. The Army Association will make the required change in accordance with the policy used at the time in the credit company. To the extent that the credit company will charge the military association a fee for the operation, the operator of the operation will be charged the aforementioned fee.
6.3. Transaction cancellations will be made according to the Consumer Protection Law 1981.
6.4. Do not give false information. Submitting false information is a criminal offense. A surfer who commits this offense is expected to face legal, criminal, and civil proceedings.
6.5. To the extent that the transaction was not approved by the credit company, the operator of the operation will receive an appropriate notification. To complete the operation, the operator of the operation must contact the ICS.
6.6. The management of the site will not bear any responsibility for illegal activity carried out by participants on the site or for any other factor that is not under its full control.
⦁ Privacy and confidentiality of information
7.1. The clearing page on the website is secured with SSL 2048bit encryption, the information about the operation is encrypted according to the guidelines of the international PCI standard, and all to ensure the confidentiality of details and information as much as possible.
7.2. The information provided by you on the website is intended for the purpose of using the website and will be preserved according to the Privacy Protection Law, 1981. ⦁ Applicable law and jurisdiction
8.1. The laws of the State of Israel shall apply to these regulations and everything arising from them or involving them, these regulations will be interpreted according to them, and any dispute or legal question in connection with it will be brought to a decision in the competent judicial court in the Jerusalem district.
